Review of the Implementation of Brussels II Regulation in Relation to Parental Abduction of Children

The authors come to the conclusion that that the parent who abducts the child to ceratin Member States appears to obtain an advantageous legal position, because - contrary to Art. 12 Hague Convention - there is no automatic and immediate decision by the relevant courts to return the child to the Member State from where it was abducted.

Moreover, the authors have observed violations of the right of the child to have access to both parents, violations of the right of the left-behind parent to have a fair trial and the frustration or at least complication of the return due to cinsiderable delays in the court proceedings in some Member States. They have also noted that in some other countries the Central Authorities and the Authorities for Youth Welfare play an important, but not always neutral role in the proceedings. As a result, a combination of the difficulties mentiones above, together with further practical difficulties, which are also outlined in the paper, can amount to a denial of effective access to justice for the left-behind parent and the child.

Diese entlarvende Studie ist inzwischen über ein Jahr alt. Sie wird hier nochmals in Erinnerung gerufen, um zu verdeutlichen, dass sich trotz deutlicher Kritik an dem deutschen System (das Wort "Germany" kommt überproportional häufig vor) nichts geändert hat. Im Gegenteil, sämtliche seitherigen Gesetzesinitiativen zielen darauf ab, nicht nur die Macht des Jugendamtes zu stärken, sondern auch die Kontrollmöglichkeiten weiter zu beschränken (Sanktionierung des "Handelns auf Verdacht" anstelle der Nachweispflicht).
Das alles zeichnet ein irritierendes Bild des deutschen Rechtsstaates. Leider werden die systematischen Menschenrechtsverletzungen durch deutsche Jugendämter und Familiengerichte in der Öffentlichkeit noch viel zu wenig wahrgenommen. Doch wer davon erfährt, ist entsetzt.
Der Presseblog hat es sich zur Aufgabe gemacht, an der Öffentlichmachung dieses himmelschreienden Unrechts mitzuwirken. Helfen Sie mit, indem Sie ihre Freunde und Bekannten auf diese Seite hinweisen.
